Litigation as a Business Strategy: Viable or a Case of Cutting off your Nose to Spite your Face?

Litigation is a tool used to attain specific goals, which may be achieved equally or even more effectively though other means. Join us in this evening talk which will focus on the factors which are the root causes of litigation, situations which are conducive and non-conducive to litigation with the help of case law and cogent reasons on when to avoid litigation.

 

From a client’s perspective, being sued may be a very expensive, time-consuming and stressful proposition. While you may win a case, it may still leave a client dissatisfied due to strain it had on his business resources. Therefore, the decision of whether or not to litigate and what the viable alternatives are to litigation must be carefully considered and well planned, so that redundant litigation can be avoided. In this talk we will cover the following areas:

 

-  The objective of litigation and its alternatives;

-  An examination of alternate strategies in different situations;

-  When and how the strategies work;

-  The role of the counsel;

-  What clients need to know and understand.
