IP Practice for Public Sector: Complying with Copyright & Managing Risks

Of all the forms of IP, copyright tends to be the one perceived as the most complex, is likely the most misused, abused or just plain ignored. Yet it is arguably the most pervasive with application in work & at home.

It is this very pervasiveness that makes proper copyright management essential in all ministries, departments and agencies. Copyright problems don’t just occur in the education sector.

In this session officers would first be given a refresher of basic copyright principles before delving into the practical management of copyright from tracking owners, keeping records, to dealing with 3rd party requests for use of government works and in collaborations.

It really would not be possible to cover all possible situations of copyright use but at the end of this session, participants should be able to:

- Apply copyright fundamentals in identifying possible issues in use of works
- Understand how copyright is used in the business context and in dealing with request
  from 3rd parties
- Put in place a simple framework for better management of key copyright assets in their organisation.

          Exceptions under the Copyright Act, and What is Copyright Clearance

          A discussion of typical situations involving use of copyright protected material
          that may result in risks scenarios on e.g. putting together a commemorative
          public education publication, resource compilation, contracting surveys, private
          exploitation of public assets.

1400 - Balancing risks and compliance: Implementing a copyright guidance policy
          Scope of policy, coverage, standard forms and procedures, implementation
          issues of copyright ownership and licensing when outsourcing to the private
          sector
