WIPO-IPOS WORKSHOP ON EXPERT DETERMINATION FOR IP AND IT DISPUTES

Patent filings are on the rise worldwide, reflecting the development of technology in the global economy. As a result, the stakes in patent disputes are rising, but inefficient dispute resolution procedures and inconsistency of outcomes across jurisdictions can cast a shadow on the marketplace. 

As one of the tools available to reduce these risks, expert determination allows disputing parties to submit a specific matter (e.g. ​a technical issue) to a subject matter expert of their choice to make a determination. Generally confidential and binding, expert determination may assist the parties in resolving the entire patent dispute (including valuation of intellectual property rights or the establishment of royalty rates), since the key areas of the dispute are usually technical in nature.

With its increasingly widespread ubiquity, social media platforms can be used as an extremely effective resource for businesses and corporations to reach its target audiences. And yet despite this, it is also a double-edged sword: because for all the exciting opportunities for leverage social media can provide, there are also new and novel challenges that it presents, including in the IP arena.

By teaching participants how to incisively identify and overcome the key IP challenges in social media, this seminar aims to assist IP practitioners in navigating the uncharted waters of social media.

WIPO–IPOS Seminar on ADR and Technology Transactions

A workshop focusing on the latest in Patent Expert Determination and Alternative DIspute Resolution.

A. Expert Determination in Patent Disputes

Expert determination provides a private, confidential and cost-effective alternative to court litigation for the resolution of patent disputes, especially those that are multi-jurisdictional. In the context of patented standards, some standards bodies resolve disputes between members as to the essentiality of a patent to a standard through binding expert determinations.

B. WIPO ADR in Technology Transactions

Decisions relating to dispute resolution mechanisms in the event of disagreements or issues arising out of technology transactions need to be taken at an early stage. This seminar will provide an overview of available WIPO alternative dispute resolution (ADR) mechanisms suitable for technology transactions. Learn how to incorporate dispute resolution provisions in IP contracts in technology transactions.

WIPO-IPOS Mediation Workshop for Intellectual Property Disputes

The Intellectual Property Office of Singapore (IPOS) and the World Intellectual Property Organization (WIPO) signed a Memorandum of Understanding (MoU) on the sidelines of the General Assembly of WIPO in September 2011. Under this MoU, IPOS and WIPO have collaborated to establish a joint dispute resolution procedure that facilitates the mediation of intellectual property disputes.

Since the launch of this new mediation option at IPOS, there has been some success and much interest on how mediation can help parties reach win-win solutions in an increasingly complex and transnational business environment.

The inaugural run of this workshop in December 2011 was very well received, with many requests for a re-run. Grab this opportunity to gain insight into how mediation can work for you and your organisation. Participants can expect an engaging and interactive workshop with role-play and discussions.

Expert Determination for Patent Disputes

Patent disputes involving complex technical issues are on the ascendency worldwide.

 

Expert determination provides an alternative, focused and cost-effective route to litigation, arbitration and mediation for the resolution of patent disputes.  In the UK, the Intellectual Property Office offers a non-binding, but public, expert determination of infringement and certain challenges to patent validity.  In the context of patented standards many standards bodies, and in particular those that operate by means of patent pools, resolve disputes between members as to the essentiality of a patent to a standard by binding expert determinations.  In Singapore, the Intellectual Property Office of Singapore is collaborating with the World Intellectual Property Organisation (WIPO) Arbitration and Mediation Center to roll out a new expert determination option for parties to patent disputes.

 

Learn about these and other applications of expert determination for patent disputes, and how the WIPO Expert Determination Rules operate and can be applied.
