Patent disputes involving complex technical issues are on the ascendency worldwide.

Expert determination provides an alternative, focused and cost-effective route to litigation, arbitration and mediation for the resolution of patent disputes.  In the UK, the Intellectual Property Office offers a non-binding, but public, expert determination of infringement and certain challenges to patent validity.  In the context of patented standards many standards bodies, and in particular those that operate by means of patent pools, resolve disputes between members as to the essentiality of a patent to a standard by binding expert determinations.  In Singapore, the Intellectual Property Office of Singapore is collaborating with the World Intellectual Property Organisation (WIPO) Arbitration and Mediation Center to roll out a new expert determination option for parties to patent disputes.

The case-study method is a preferred manner of instruction in various contexts, especially in management education, to highlight tactical and strategic decisions. It has been used much less in the IP context, despite the value that such an approach for enabling both IP practitioners and commercial lawyers to better understand the role that IP plays in various commercial and related settings.

While intellectual property rights are usually presented as discrete rights, in practice, overlaps between two or more IP rights are a regular occurrence. Based on a new book to be published at the end of July by Oxford University Press on the subject, this program will address how this approach to understanding the law and practice of IP rights.

The commercialization of IP rights has become a central function of IP.   IP commercialization is especially challenging because it requires an understanding of IP, commercial and contract law, and business considerations. This program will focus on how these interrelated considerations are brought to bear on key aspects of M&A transactions and IP licensing.
