Many of these companies are utilizing their patents offensively and defensively in ongoing litigations in various jurisdictions around the world. Even “patent trolls” have jumped into smartphone litigations realizing the potential large returns on patent licensing and litigation in the smartphone realm. Are these manufacturers and “trolls” taking advantage of weaknesses in patent systems around the world? Is this a sign that patent offices granting more and more patents to incremental innovations are contributing to a pending breakdown in the patent systems?

Expert Determination for Patent Disputes
16 Oct 2012

*This is a SILE accredited course. 3 public CPD points are avalaible for lawyers.

Patent disputes involving complex technical issues are on the ascendency worldwide.

Expert determination provides an alternative, focused and cost-effective route to litigation, arbitration and mediation for the resolution of patent disputes.  In the UK, the Intellectual Property Office offers a non-binding, but public, expert determination of infringement and certain challenges to patent validity.  In the context of patented standards many standards bodies, and in particular those that operate by means of patent pools, resolve disputes between members as to the essentiality of a patent to a standard by binding expert determinations.  In Singapore, the Intellectual Property Office of Singapore is collaborating with the World Intellectual Property Organisation (WIPO) Arbitration and Mediation Center to roll out a new expert determination option for parties to patent disputes.

Learn about these and other applications of expert determination for patent disputes, and how the WIPO Expert Determination Rules operate and can be applied.

If you are a technical expert in your field, this workshop will equip you with skills to conduct expert determination as a prospective member of WIPO Arbitration and Mediation Center's Panel of Neutrals.  If you represent your clients in patent disputes, you will gain insight into how to prepare for expert determination and achieve an effective and efficient resolution in your clients' disputes.  If you or your company owns or manages a patent portfolio, learn about the benefits of expert determination and how it can be used to resolve patent disputes effectively.
